There are lots of things we can do to

technique we like to use at multiple points throughout the litigation is
expected value analysis. Like Stephen Covey's "begin with the end in
mind", computing the expected value helps clients focus on the
litigation's outcome - the final judgment rendered by the judge or
jury. Because the pre-trial process is often lengthy and filled with
procedural matters, combatants often get caught up in the battle and
lose focus on where the litigation is heading.
